貫徹落(luo)實《國務(wu)(wu)院辦公廳關(guan)于促進建筑業持(chi)續健康(kang)發展的意見》重(zhong)點(dian)任務(wu)(wu)分工方(fang)案

為貫徹落實《國務院(yuan)辦(ban)公廳關于促進建筑業持續健康(kang)發展的意見》(國辦(ban)發〔2017〕19號(hao))有關要求,明確工作(zuo)職責,統籌推(tui)進建筑業改革發展工作(zuo),制定如下分工方案:

一、深化建(jian)筑業簡政放權改革(ge)

(一)優化資(zi)(zi)質(zhi)資(zi)(zi)格(ge)管(guan)理。進(jin)一步簡(jian)化工(gong)程(cheng)建(jian)(jian)(jian)設(she)企業資(zi)(zi)質(zhi)類(lei)別(bie)和(he)等級設(she)置,減少不必要的(de)(de)資(zi)(zi)質(zhi)認定。選擇部(bu)(bu)(bu)分地(di)區開展試點,對信(xin)用(yong)良好、具(ju)有相(xiang)關專業技術(shu)能力(li)、能夠(gou)提供足額(e)擔(dan)保(bao)(bao)的(de)(de)企業,在其資(zi)(zi)質(zhi)類(lei)別(bie)內放寬承攬業務(wu)(wu)范(fan)圍限制(zhi),同(tong)(tong)時,加快完善(shan)信(xin)用(yong)體系、工(gong)程(cheng)擔(dan)保(bao)(bao)及個(ge)(ge)人(ren)(ren)執(zhi)(zhi)業資(zi)(zi)格(ge)等相(xiang)關配套制(zhi)度,加強事中(zhong)事后監管(guan)。強化個(ge)(ge)人(ren)(ren)執(zhi)(zhi)業資(zi)(zi)格(ge)管(guan)理,明晰注冊執(zhi)(zhi)業人(ren)(ren)員(yuan)的(de)(de)權利(li)、義務(wu)(wu)和(he)責(ze)任(ren),加大執(zhi)(zhi)業責(ze)任(ren)追究力(li)度。有序(xu)發展個(ge)(ge)人(ren)(ren)執(zhi)(zhi)業事務(wu)(wu)所,推動建(jian)(jian)(jian)立個(ge)(ge)人(ren)(ren)執(zhi)(zhi)業保(bao)(bao)險制(zhi)度。大力(li)推行(xing)“互聯(lian)網+”政務(wu)(wu)服務(wu)(wu),實行(xing)“一站式”網上審批(pi),進(jin)一步提高(gao)建(jian)(jian)(jian)筑(zhu)領域行(xing)政審批(pi)效率。(住房城鄉建(jian)(jian)(jian)設(she)部(bu)(bu)(bu)、國務(wu)(wu)院審改辦、工(gong)業和(he)信(xin)息化部(bu)(bu)(bu)、人(ren)(ren)力(li)資(zi)(zi)源社(she)會保(bao)(bao)障部(bu)(bu)(bu)、交通(tong)運輸部(bu)(bu)(bu)、水利(li)部(bu)(bu)(bu)、保(bao)(bao)監會、鐵路局、民航局。列第(di)一位(wei)者(zhe)為(wei)牽頭部(bu)(bu)(bu)門或單(dan)位(wei),其他有關部(bu)(bu)(bu)門按職責(ze)分工(gong)負責(ze),下同(tong)(tong))

(二)完善招標投標制度。加快(kuai)修訂(ding)《工(gong)程(cheng)建(jian)設項(xiang)(xiang)目(mu)招標范圍和規模標準規定》,縮小并嚴(yan)格界定必須進行招標的工(gong)程(cheng)建(jian)設項(xiang)(xiang)目(mu)范圍,放寬(kuan)有(you)關規模標準,防止工(gong)程(cheng)建(jian)設項(xiang)(xiang)目(mu)實(shi)行招標“一刀切”。

在民間(jian)投(tou)資的(de)(de)(de)房屋(wu)建筑工程(cheng)(cheng)(cheng)中,探索由建設單位(wei)自主決定發(fa)包方(fang)式。將(jiang)依法必須招標(biao)(biao)(biao)(biao)的(de)(de)(de)工程(cheng)(cheng)(cheng)建設項目納入(ru)統一(yi)(yi)的(de)(de)(de)公共資源(yuan)交易(yi)平(ping)臺,遵循公平(ping)、公正、公開和(he)誠信的(de)(de)(de)原則(ze),規范招標(biao)(biao)(biao)(biao)投(tou)標(biao)(biao)(biao)(biao)行為。進一(yi)(yi)步簡化招標(biao)(biao)(biao)(biao)投(tou)標(biao)(biao)(biao)(biao)程(cheng)(cheng)(cheng)序(xu),盡(jin)快實(shi)現招標(biao)(biao)(biao)(biao)投(tou)標(biao)(biao)(biao)(biao)交易(yi)全(quan)過程(cheng)(cheng)(cheng)電子(zi)化,推(tui)行網上異地評標(biao)(biao)(biao)(biao)。對依法通過競爭性談判或單一(yi)(yi)來(lai)源(yuan)方(fang)式確(que)定供應商的(de)(de)(de)政(zheng)(zheng)府采購工程(cheng)(cheng)(cheng)建設項目,符合相應條件(jian)的(de)(de)(de)應當頒(ban)發(fa)施工許可證。(發(fa)展(zhan)改革委(wei)、住房城鄉建設部(bu)、工業和(he)信息(xi)化部(bu)、財政(zheng)(zheng)部(bu)、交通運(yun)輸(shu)部(bu)、水(shui)利部(bu)、法制辦(ban)、鐵(tie)路(lu)局、民航(hang)局)

二、完善工程建(jian)設(she)組織模(mo)式

(三)加(jia)快推(tui)行(xing)工(gong)(gong)(gong)程(cheng)總(zong)承包(bao)(bao)。裝配式建筑原則上應采用(yong)工(gong)(gong)(gong)程(cheng)總(zong)承包(bao)(bao)模式。政府(fu)投(tou)資工(gong)(gong)(gong)程(cheng)應完善(shan)建設管理(li)模式,帶(dai)頭推(tui)行(xing)工(gong)(gong)(gong)程(cheng)總(zong)承包(bao)(bao)。加(jia)快完善(shan)工(gong)(gong)(gong)程(cheng)總(zong)承包(bao)(bao)相關的招標(biao)(biao)投(tou)標(biao)(biao)、施工(gong)(gong)(gong)許可、竣工(gong)(gong)(gong)驗(yan)收等制(zhi)度規定(ding)。按照總(zong)承包(bao)(bao)負總(zong)責的原則,落實(shi)工(gong)(gong)(gong)程(cheng)總(zong)承包(bao)(bao)單位(wei)在(zai)工(gong)(gong)(gong)程(cheng)質量安全(quan)、進度控(kong)制(zhi)、成本管理(li)等方面的責任。除以暫估價形(xing)式包(bao)(bao)含在(zai)工(gong)(gong)(gong)程(cheng)總(zong)承包(bao)(bao)范圍內且依法必(bi)須進行(xing)招標(biao)(biao)的項目外,工(gong)(gong)(gong)程(cheng)總(zong)承包(bao)(bao)單位(wei)可以直接(jie)發(fa)(fa)包(bao)(bao)總(zong)承包(bao)(bao)合(he)同中涵蓋的其(qi)他專(zhuan)業業務。(住房城鄉建設部(bu)、發(fa)(fa)展改革委、工(gong)(gong)(gong)業和(he)信(xin)息化(hua)部(bu)、財政部(bu)、交(jiao)通運(yun)輸部(bu)、水利部(bu)、鐵路局、民航局)

(四)培(pei)育(yu)全過(guo)程(cheng)(cheng)(cheng)(cheng)工(gong)程(cheng)(cheng)(cheng)(cheng)咨(zi)(zi)(zi)詢(xun)(xun)。鼓勵投(tou)資(zi)咨(zi)(zi)(zi)詢(xun)(xun)、勘察、設(she)計、監理(li)、招標代理(li)、造價(jia)等(deng)企業(ye)(ye)采取聯合經營、并購重(zhong)組等(deng)方式發展(zhan)全過(guo)程(cheng)(cheng)(cheng)(cheng)工(gong)程(cheng)(cheng)(cheng)(cheng)咨(zi)(zi)(zi)詢(xun)(xun),培(pei)育(yu)一批具有國(guo)際水平的全過(guo)程(cheng)(cheng)(cheng)(cheng)工(gong)程(cheng)(cheng)(cheng)(cheng)咨(zi)(zi)(zi)詢(xun)(xun)企業(ye)(ye)。制定全過(guo)程(cheng)(cheng)(cheng)(cheng)工(gong)程(cheng)(cheng)(cheng)(cheng)咨(zi)(zi)(zi)詢(xun)(xun)服務(wu)技(ji)術標準和合同范本。政(zheng)府投(tou)資(zi)工(gong)程(cheng)(cheng)(cheng)(cheng)應(ying)帶頭推行(xing)全過(guo)程(cheng)(cheng)(cheng)(cheng)工(gong)程(cheng)(cheng)(cheng)(cheng)咨(zi)(zi)(zi)詢(xun)(xun),鼓勵非政(zheng)府投(tou)資(zi)工(gong)程(cheng)(cheng)(cheng)(cheng)委托全過(guo)程(cheng)(cheng)(cheng)(cheng)工(gong)程(cheng)(cheng)(cheng)(cheng)咨(zi)(zi)(zi)詢(xun)(xun)服務(wu)。在(zai)民(min)用建筑(zhu)項目(mu)中,充分發揮建筑(zhu)師的主導(dao)作用,鼓勵提供全過(guo)程(cheng)(cheng)(cheng)(cheng)工(gong)程(cheng)(cheng)(cheng)(cheng)咨(zi)(zi)(zi)詢(xun)(xun)服務(wu)。(發展(zhan)改革委、住房城鄉建設(she)部(bu)共同牽頭,工(gong)業(ye)(ye)和信息化部(bu)、財政(zheng)部(bu)、交(jiao)通運輸(shu)部(bu)、水利(li)部(bu)、工(gong)商總局、鐵路局、民(min)航局)

三、加強工程質量安(an)全管理

(五)嚴(yan)格(ge)落實(shi)工(gong)程(cheng)(cheng)(cheng)質(zhi)(zhi)量(liang)(liang)責(ze)(ze)任(ren)。全(quan)面(mian)落實(shi)各方主體(ti)(ti)工(gong)程(cheng)(cheng)(cheng)質(zhi)(zhi)量(liang)(liang)責(ze)(ze)任(ren),特別要(yao)強化(hua)建(jian)設(she)單(dan)(dan)位(wei)的(de)首(shou)要(yao)責(ze)(ze)任(ren)和勘察、設(she)計、施工(gong)單(dan)(dan)位(wei)的(de)主體(ti)(ti)責(ze)(ze)任(ren)。嚴(yan)格(ge)執(zhi)行工(gong)程(cheng)(cheng)(cheng)質(zhi)(zhi)量(liang)(liang)終身責(ze)(ze)任(ren)制,在(zai)建(jian)筑(zhu)物(wu)明顯部(bu)(bu)位(wei)設(she)置永(yong)久性(xing)標牌,公示質(zhi)(zhi)量(liang)(liang)責(ze)(ze)任(ren)主體(ti)(ti)和主要(yao)責(ze)(ze)任(ren)人。對違反有關規(gui)定、造成工(gong)程(cheng)(cheng)(cheng)質(zhi)(zhi)量(liang)(liang)事故的(de),依(yi)法(fa)給予(yu)責(ze)(ze)任(ren)單(dan)(dan)位(wei)停(ting)業(ye)(ye)(ye)(ye)整(zheng)頓(dun)、降(jiang)低資質(zhi)(zhi)等(deng)級、吊(diao)銷資質(zhi)(zhi)證(zheng)書等(deng)行政處(chu)罰并(bing)通(tong)過國家(jia)企業(ye)(ye)(ye)(ye)信(xin)用信(xin)息公示系統予(yu)以公示,給予(yu)注冊執(zhi)業(ye)(ye)(ye)(ye)人員暫停(ting)執(zhi)業(ye)(ye)(ye)(ye)、吊(diao)銷資格(ge)證(zheng)書、一定時間(jian)直至終身不(bu)得進(jin)入行業(ye)(ye)(ye)(ye)等(deng)處(chu)罰。對發生工(gong)程(cheng)(cheng)(cheng)質(zhi)(zhi)量(liang)(liang)事故造成損失的(de),要(yao)依(yi)法(fa)追(zhui)究(jiu)(jiu)經濟賠償責(ze)(ze)任(ren),情節(jie)嚴(yan)重(zhong)的(de)要(yao)追(zhui)究(jiu)(jiu)有關單(dan)(dan)位(wei)和人員的(de)法(fa)律責(ze)(ze)任(ren)。參(can)與房(fang)地產開發的(de)建(jian)筑(zhu)業(ye)(ye)(ye)(ye)企業(ye)(ye)(ye)(ye)應(ying)依(yi)法(fa)合規(gui)經營,提高住(zhu)(zhu)宅品(pin)質(zhi)(zhi)。(住(zhu)(zhu)房(fang)城(cheng)鄉建(jian)設(she)部(bu)(bu)、發展改革(ge)委、工(gong)業(ye)(ye)(ye)(ye)和信(xin)息化(hua)部(bu)(bu)、財政部(bu)(bu)、交(jiao)通(tong)運輸部(bu)(bu)、水利部(bu)(bu)、工(gong)商(shang)總局、鐵路局、民航(hang)局)

(六(liu))加強安(an)(an)全(quan)(quan)生產管(guan)理。全(quan)(quan)面落實(shi)安(an)(an)全(quan)(quan)生產責任,加強施工(gong)現(xian)場安(an)(an)全(quan)(quan)防護,特別要強化對深(shen)基(ji)坑、高(gao)支模、起重機(ji)械(xie)等危險(xian)(xian)性較(jiao)大的(de)分部(bu)分項工(gong)程(cheng)管(guan)理,以(yi)及不(bu)良地(di)質(zhi)地(di)區重大工(gong)程(cheng)項目(mu)的(de)風險(xian)(xian)評(ping)估或論(lun)證(zheng)。推(tui)進信(xin)(xin)息(xi)(xi)技術與安(an)(an)全(quan)(quan)生產的(de)深(shen)度融合(he),加快建(jian)(jian)設建(jian)(jian)筑施工(gong)安(an)(an)全(quan)(quan)監管(guan)信(xin)(xin)息(xi)(xi)系統(tong),通過信(xin)(xin)息(xi)(xi)化手段加強安(an)(an)全(quan)(quan)生產管(guan)理。建(jian)(jian)立健(jian)全(quan)(quan)全(quan)(quan)覆蓋、多層次、經常性的(de)安(an)(an)全(quan)(quan)生產培訓(xun)制度,提升從業人(ren)員安(an)(an)全(quan)(quan)素質(zhi)以(yi)及各方(fang)主體的(de)本質(zhi)安(an)(an)全(quan)(quan)水(shui)平。(住房(fang)城鄉建(jian)(jian)設部(bu)、工(gong)業和信(xin)(xin)息(xi)(xi)化部(bu)、交(jiao)通運(yun)輸部(bu)、水(shui)利部(bu)、安(an)(an)全(quan)(quan)監管(guan)總局、鐵路(lu)局、民航局)

(七(qi))全(quan)(quan)(quan)面(mian)提高(gao)監(jian)(jian)管水平(ping)。完(wan)善(shan)工(gong)(gong)(gong)程(cheng)(cheng)質(zhi)量(liang)(liang)(liang)安全(quan)(quan)(quan)法(fa)律法(fa)規和(he)管理(li)(li)制度,健(jian)全(quan)(quan)(quan)企業負(fu)責、政(zheng)府(fu)監(jian)(jian)管、社(she)(she)會監(jian)(jian)督(du)的(de)質(zhi)量(liang)(liang)(liang)安全(quan)(quan)(quan)保(bao)障體(ti)(ti)(ti)系。強(qiang)(qiang)(qiang)(qiang)化(hua)政(zheng)府(fu)對(dui)工(gong)(gong)(gong)程(cheng)(cheng)質(zhi)量(liang)(liang)(liang)的(de)監(jian)(jian)管,明確監(jian)(jian)管范圍,落(luo)實監(jian)(jian)管責任,加(jia)大抽查抽測力(li)度,重點加(jia)強(qiang)(qiang)(qiang)(qiang)對(dui)涉(she)及公共安全(quan)(quan)(quan)的(de)工(gong)(gong)(gong)程(cheng)(cheng)地(di)(di)基基礎、主(zhu)體(ti)(ti)(ti)結構等(deng)部(bu)位和(he)竣工(gong)(gong)(gong)驗(yan)收等(deng)環節的(de)監(jian)(jian)督(du)檢(jian)(jian)查。加(jia)強(qiang)(qiang)(qiang)(qiang)工(gong)(gong)(gong)程(cheng)(cheng)質(zhi)量(liang)(liang)(liang)監(jian)(jian)督(du)隊伍(wu)建設,監(jian)(jian)督(du)機構履行職能所需經費由同(tong)級財政(zheng)預算全(quan)(quan)(quan)額保(bao)障。政(zheng)府(fu)可(ke)采(cai)取購買(mai)服務的(de)方式,委托具備條件的(de)社(she)(she)會力(li)量(liang)(liang)(liang)進(jin)行工(gong)(gong)(gong)程(cheng)(cheng)質(zhi)量(liang)(liang)(liang)監(jian)(jian)督(du)檢(jian)(jian)查。推(tui)進(jin)工(gong)(gong)(gong)程(cheng)(cheng)質(zhi)量(liang)(liang)(liang)安全(quan)(quan)(quan)標準化(hua)管理(li)(li),督(du)促(cu)各方主(zhu)體(ti)(ti)(ti)健(jian)全(quan)(quan)(quan)質(zhi)量(liang)(liang)(liang)安全(quan)(quan)(quan)管控(kong)機制。強(qiang)(qiang)(qiang)(qiang)化(hua)對(dui)工(gong)(gong)(gong)程(cheng)(cheng)監(jian)(jian)理(li)(li)的(de)監(jian)(jian)管,選擇(ze)部(bu)分(fen)地(di)(di)區(qu)開展(zhan)監(jian)(jian)理(li)(li)單位向政(zheng)府(fu)報(bao)告(gao)質(zhi)量(liang)(liang)(liang)監(jian)(jian)理(li)(li)情況的(de)試點。加(jia)強(qiang)(qiang)(qiang)(qiang)工(gong)(gong)(gong)程(cheng)(cheng)質(zhi)量(liang)(liang)(liang)檢(jian)(jian)測機構管理(li)(li),嚴厲打擊出具虛(xu)假(jia)報(bao)告(gao)等(deng)行為(wei)。推(tui)動發(fa)展(zhan)工(gong)(gong)(gong)程(cheng)(cheng)質(zhi)量(liang)(liang)(liang)保(bao)險。(住房城鄉建設部(bu)、工(gong)(gong)(gong)業和(he)信(xin)息化(hua)部(bu)、財政(zheng)部(bu)、交(jiao)通運輸部(bu)、水利部(bu)、安全(quan)(quan)(quan)監(jian)(jian)管總局(ju)、保(bao)監(jian)(jian)會、鐵路局(ju)、民航(hang)局(ju))

四、優化建筑市場(chang)環境

(八)建(jian)立統一開放市(shi)(shi)場(chang)。打破區域市(shi)(shi)場(chang)準入(ru)壁壘,取消各地區、各行業(ye)(ye)在法(fa)(fa)律、行政法(fa)(fa)規(gui)或國務院規(gui)定外對建(jian)筑業(ye)(ye)企(qi)業(ye)(ye)設(she)(she)(she)(she)置的不合理準入(ru)條(tiao)件(jian);嚴禁(jin)擅自設(she)(she)(she)(she)立或變相設(she)(she)(she)(she)立審(shen)批、備案事項,為建(jian)筑業(ye)(ye)企(qi)業(ye)(ye)提(ti)供公(gong)平(ping)(ping)市(shi)(shi)場(chang)環境(jing)。完(wan)善全(quan)國建(jian)筑市(shi)(shi)場(chang)監管公(gong)共(gong)服務平(ping)(ping)臺,加(jia)快實現與(yu)全(quan)國信用信息(xi)共(gong)享(xiang)平(ping)(ping)臺和(he)國家企(qi)業(ye)(ye)信用信息(xi)公(gong)示系統的數(shu)據共(gong)享(xiang)交換(huan)。建(jian)立建(jian)筑市(shi)(shi)場(chang)主體黑(hei)名單制度,依(yi)法(fa)(fa)依(yi)規(gui)全(quan)面(mian)公(gong)開企(qi)業(ye)(ye)和(he)個人優良信用記(ji)錄和(he)不良信用記(ji)錄,接(jie)受社會(hui)監督。(住房(fang)城鄉建(jian)設(she)(she)(she)(she)部、發展改(gai)革委(wei)、工業(ye)(ye)和(he)信息(xi)化部、交通運(yun)輸部、水利部、稅務總(zong)局(ju)、工商總(zong)局(ju)、法(fa)(fa)制辦、鐵路局(ju)、民航局(ju))

各(ge)地(di)區(qu)、各(ge)部(bu)門(men)(men)(men)(men)要(yao)高度重視深(shen)化(hua)建(jian)筑業改革工作(zuo),健全工作(zuo)機制,明確任務(wu)分工,及時(shi)研究(jiu)解決建(jian)筑業改革發展(zhan)中(zhong)的(de)重大(da)問(wen)題,完善(shan)相關政策。同一項工作(zuo)涉及多個(ge)部(bu)門(men)(men)(men)(men)的(de),牽頭部(bu)門(men)(men)(men)(men)要(yao)加強(qiang)協調,強(qiang)化(hua)部(bu)門(men)(men)(men)(men)間協作(zuo),推動工作(zuo)落實。各(ge)省、自治區(qu)、直轄市人民政府(fu)相關部(bu)門(men)(men)(men)(men)要(yao)發揮主動性(xing),加強(qiang)與(yu)有關部(bu)門(men)(men)(men)(men)溝(gou)通銜接(jie),制定(ding)本地(di)區(qu)實施細則。
